The Ministry of Transport has submitted amendments to the Instruction on the procedure for distributing, issuing and using permits for the passage of vehicles for public discussion

The draft resolution of the Ministry of Transport “On Amending the Resolution of the Ministry of Transport and Communications of the Republic of Belarus dated November 30, 2018 No. 28” has been submitted for public discussion.

The draft resolution makes amendments to the Instruction on the procedure for distributing, issuing and using permits for the passage of vehicles registered in the Republic of Belarus through the territory of foreign states when performing international road transport, approved by the Resolution of the Ministry of Transport dated November 30, 2018 No. 28 (hereinafter referred to as the Instruction).

In order to improve the legal regulation of the procedure for the distribution, issuance and use of permits for travel through the territory of one foreign state (hereinafter referred to as permits) and permits for travel through the territory of several foreign states (hereinafter referred to as ECMT permits), taking into account the practice of its application, it is proposed to introduce the following innovations into the Instruction:

  • change in the deadline for submitting the balance sheet for the previous year to the Transport Inspectorate – no later than April 30;
  • clarification of the scope of information indicated in the list of drivers;
  • establishment of the issuance, in the period up to and including 31 March, of undistributed permits in an amount of no more than 5% of the rolling stock (if, as of 23 December of the previous year, 50% or more of the number of permits of the relevant type have not been returned, from the date of issue of which 180 calendar days or more have passed);
  • changing the maximum ratio of the volume of revenue of a road carrier to the total volume of revenue of road carriers in the permit distribution formula from 1.15 to 1.25;
  • establishing the procedure for issuing distributed permits not received based on the results of the first, second or third quarters from the part determined by the order of the Ministry of Transport, as permits not subject to distribution;
  • extension of the period for which the analysis of the efficiency of the use of ECMT permits by road carriers is made when distributing such permits for the next calendar year, to the period from 1 September to 31 December of the year preceding the current calendar year.

It is also proposed to make a number of changes to the Instruction from January 1, 2026 (in connection with the need to improve the automated information system for recording and issuing permits):

  • establishment of a 30-day limit on the registration of vehicles in the number of rolling stock in the event of their use on the basis of lease agreements and with body numbers identical to the body numbers of freight vehicles previously (within the last 30 calendar days) declared for use on the basis of lease agreements by other road carriers;
  • establishing, when issuing non-distributed permits (ECMT permits), a limit on the number of trucks used that does not exceed the number of drivers represented;
  • establishing, for non-distributed permits (ECMT permits), the possibility of returning not the original used permit, but a copy of it, with the original provided within 30 calendar days;
  • extension of the provisions of part four of paragraph 11 of the Instructions on reducing the number of permits not subject to distribution and issued in accordance with paragraph 9 of the Instructions, by one permit for each case of violation of the established return period, including violation of the return period of the original used permit corresponding to the previously submitted copy;
  • disclosure, by the road carrier in the personal account of the automated system before returning the used permits to the Transport Inspectorate, of information about their use.
